Overview of NYGATS Compliance
There are three Compliance tables in the NYGATS that each help LSEs understand their recorded Load and resulting obligations:
- LSE Tier 1 REC Preliminary Compliance Report – Provides information regarding RES Compliance
- LSE Tier 2 Compliance Summary – Provides information regarding Tier 2 Compliance
- LSE ZEC Compliance Summary – Provides information regarding ZEC Compliance
Note: All three of the above Compliance tables are located on an LSE’s homepage through their Account Status module
LSE Tier 1 REC Preliminary Compliance Report
The LSE Tier 1 REC Preliminary Compliance Report is a module that summarizes an LSE’s Annual RES Compliance
- The load data provided in the LSE Tier 1 REC Preliminary Compliance Report is the most recent V2 data provided by the NYISO.
- There is a 5-month lag between when the load occurs and when the V2 version of the data is available in NYGATS.
- An LSE will transfer Tier 1 RECs into the EDP Sub-Account to fulfill their Tier 1 REC obligations

- All Transfers must be completed by the end of the Trading Period, which occurs on June 30th following the end of the vintage year
- The Account Holder can view their Tier 1 Obligation against the quantity of Tier 1 RECs deposited within various Sub- Accounts (EDP, Banked, Active)
- For instance, if the Obligation was100, the EDP Sub-Account was 50 and the Banked was 20, then the LSE would have a Tier 1 balance of -30.

The LSE Tier 1 REC Preliminary Compliance Report contains the following columns:
Column Name |
Description |
Compliance Year (January – December) |
This identifies the Renewable Energy Standard Compliance Year The table will display information for five (5) Compliance Years. The first year is 2017. |
LSE Total Load (MWh) through [Month Year] |
LSE total electrical load for the Compliance Year beginning with the first month of the Compliance Year through the month indicated. This load will be based on the most recent NYISO V2 data received by NYGATS. |
Tier 1 REC Obligation % |
Percentage of LSE load required to be met with Tier 1 RECs for the Compliance Year as ordered by the New York Public Service Commission. |
Tier 1 REC Obligation |
Number of Tier 1 RECS that comprise the LSE’s Tier 1 REC obligation for the Compliance Year based on the most recent data in NYGATS. The Tier 1 REC obligation is the LSE's Total Load for the Compliance Year multiplied by the Tier 1 REC Obligation % for that Compliance Year. |
Tier 1 RECs Banked |
Number of Tier 1 RECs in LSE’s Banked Sub-Accounts. The column will always be zero for settled years since any remaining Banked Tier 1 RECs from settled vintage years will display in the current year. |
Tier 1 RECs Active |
Number of Tier 1 RECs in LSE’s Active Sub-Accounts. |
Tier 1 RECs EDP |
Number of Tier 1 RECs in LSE’s EDP Sub-Accounts by year transferred with the reason of 'RES Compliance'. Tier 1 RECs retired for other reasons are not included. |
Tier 1 REC Balance |
The difference between Tier 1 RECs EDP (with reason 'RES Compliance') and the Tier 1 REC Obligation for a given Compliance Year. Negative numbers are displayed in parenthesis. |
ACP Price |
ACP Price is the unit (MWh) cost of an Alternative Compliance Payment as approved by the New York Public Service Commission for the Compliance Year. |
Potential ACP Total Charge |
The ACP Charge provides the LSE with an indication of the current cost of Compliance if achieved by paying an ACP. ACP Charge is the Tier 1 REC Balance multiplied by the ACP price. This information is provided for informational purposes only and is based on the most recent data stored in NYGATS. |
NOTE: When the Tier 1 REC balance is equal to 0, then you have satisfied your Tier 1 obligation for that Compliance year. No further action is required on your part for that year.
LSE Tier 2 Compliance Summary
Located in the Account Status Module, the LSE Tier 2 Compliance Summary table includes Tier 2 Compliance information for the current Compliance Year (to date) and the previous year.
- The Tier 2 Compliance Year is the standard January- December
The LSE Tier 2 Compliance Summary table will have the following columns:

LSE Preliminary Load (MWh) through [Month Year] |
LSE total electrical load for the Compliance Year beginning with the first month of the Compliance Year through the month indicated.
The total equals the sum of preliminary Load snapshots that are associated with PAID monthly invoices.

The rate that will be used for monthly Tier 2 invoices. |
Preliminary Tier 2 Charges |
Sum of all payments from monthly invoices marked paid. |
Final Total NY Load through December 2020 |
Total NY Load to be used in yearly Tier 2 reconciliation.

The rate that will be used for the final Tier 2 reconciliation and annual invoice. |

LSE ZEC Compliance Summary
The LSE ZEC Compliance Summary is also accessible from the Account Status Module. This table includes yearly ZEC Compliance information for the current (to date) and four previous Compliance years
- ZEC Compliance Year is April-March (e.g. where 2021 would be April 2021 - March 2022)
- ZECs are automatically transferred into your account from NYSERDA and does not require any further transferring to EDP or other Sub-Accounts by the Account Holder
The LSE ZEC Compliance Summary table will have the following columns:
